The Inner Wisdom Retreat is a program of the company Earth Wisdom, Inc.   

PARTICIPATION RELEASE AND WAIVER OF LIABILITY

By completing this registration and submitting payment, you consent to the following Participation Release and Waiver of Liability:

I am executing this Participant Release and Liability Waiver (“Release”) in connection with my voluntary participation in the Inner Wisdom Retreat and any and all related events and activities (the “Event”) provided by Earth Wisdom, Inc., a North Carolina corporation (the “Earth Wisdom”), on July 18-21, 2024 at High Pastures Retreat Center (“Property”), which is owned by High Pastures Camp (“Host”). In consideration of my participation in the Event, and other good and valuable consideration, I agree to all the terms and conditions set forth below:

My choice to participate in the Event is knowing, voluntary, and made for my personal enjoyment. I acknowledge that the travel to or from Property facilities and Property locations, and use of and participation in the Property and Event facilities, equipment, merchandise, services, and programs may involve an inherent risk of personal injury and/or loss of property and may expose me to a variety of foreseen and unforeseen hazards and risks. I understand such injury may occur during ground travel provided or required as part of participation in the Event. I further understand that neither the Host, Earth Wisdom, nor any of their representatives, agents, owners, officers, employees, or instructors have represented that the Property has been rendered safe for entry by persons, including myself. I understand that the Host makes reasonable effort to identify ingredients in food that might be served during the Event, but I agree that neither the Host, Earth Wisdom, nor any of their representatives, agents, owners, officers, employees, or instructors assume any liability for adverse reactions for food consumed or items that I may come in contact with while participating in the Event.

I acknowledge that it is my responsibility, and I agree, to inform Earth Wisdom and the instructor of any physical limitations that could be aggravated by physical activity (i.e. back, neck, shoulder or knee problems) before any movement class begins, however, it remains my responsibility to determine whether or not to participate in any activities.  As is the case with any physical activity, yoga and movement include a risk of injury, which is potentially serious or disabling. This risk is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will listen to my body, discontinue the activity, and ask for support from the instructor. Yoga and movement are not a substitute for medical attention, examination, diagnosis or treatment. Yoga is not recommended and is not safe under certain medical conditions. I affirm that a licensed physician has verified my good health and physical condition to participate in such a yoga and movement program. In addition, I will make the instructor aware of any medical conditions or physical limitations before class. If I am pregnant, become pregnant or I am post-natal or post-surgical, my registration verifies that I have my physician's approval to participate. I also affirm that I alone am responsible to decide whether to practice yoga and movement, and participation is at my own risk.

I assume all risks and full responsibility for any and all damages which may incur through my participation in the Event.  I, the participant, for myself and my heirs, successors, and assigns, hereby waive, release, and forever discharge the Host, Earth Wisdom, and their affiliates, successors and assigns, shareholders, members, partners, officers, directors, managers, agents, employees, representatives, and volunteers (collectively, the “Released Parties”), from any and all responsibilities, claims, causes of action, damages, costs or expenses of any kind, or liability arising from or in any way connected to the Event, including, but not limited to, injury or illness resulting from participation in any Event activities, including but not limited to lectures, discussions or yoga and movement programs, injury or illness resulting from food consumption, travel to or from the Event, and contact with other participants (collectively, the “Claims”). I agree not to file suit or grievance or make any Claims against the Released Parties in any local, state, or federal court or administrative office on account of any injuries or damages covered herein.

I expressly agree that this Release shall cover all physical and emotional injuries and/or damages, including without limitation all bodily injury (including death) and property damage, whether suffered by me or anyone else, during or after the Event. I consent to receive medical treatment which may be deemed necessary in the event of any illness, accident, injury or medical emergency resulting from or in connection with my participation in the Event and understand that I am solely responsible for all costs related to such medical treatment and/or medical transportation. I represent to the Released Parties that I am in good health and suffer from no physical impairment or medical condition which might limit my ability to participate in the Event. I acknowledge and agree, however, that nothing herein shall impose any obligation on the Released Parties to provide any medical treatment or otherwise assist me if I am injured or otherwise require medical attention while on the Property and participating in the Event.

I acknowledge that in connection with the Event that instructions, restrictions, and guidelines (collectively the “Guidelines”) will be communicated to me by the Released Parties. I agree to abide by the Guidelines for my own personal safety as well as the safety of other participants and guests of the Host and Earth Wisdom. In addition to the absolute and unqualified release from all liability as described herein, I hereby represent that I will conduct myself in a safe and prudent manner while participating in the Event. The Host and Earth Wisdom each reserve the right to cancel the Event or release a participant at any time if they feel the conduct of the participant is inappropriate or disruptive, or for whatever reason.

I am aware that the COVID-19 pandemic creates additional risks in connection with the Event. I acknowledge that by participating in the Event, I risk exposure to and/or development of COVID-19. I acknowledge that I am voluntarily choosing to participate in the Event and have considered those risks. I expressly and specifically assume such risks associated with COVID-19, including any and all risk of injury, harm, or loss that may incur as result of participating in the Event. If at any time I believe conditions to be unsafe or that I am no longer in proper physical condition to participate in the Event, I will immediately discontinue further participation in the Event.

I hereby agree to irrevocably release and waive any claims that I have now or may have hereafter against the Released Parties.  On my own behalf and on behalf of my heirs, heirs, successors, and assigns I hereby agree to indemnify and hold each of the Released Parties harmless from and against any and all Claims made or incurred by anyone, including any third parties or myself, arising out of or in any way connected to the representations I have made in this Release, my participation in the Event, or any other errors, negligence, acts and/or omissions by me, wherever or whenever such activities or events may occur and whether suffered before, during or after such participation. My indemnification obligations shall include, without limitation, all attorneys’ fees, costs and judgments incurred by any of the Released Parties through and including any appeals.

If any provision or part thereof of this Release is held to be invalid, void, or unenforceable by a court of competent jurisdiction, such provision or part thereof shall be deemed modified to conform to applicable law, or if this would cause an illogical or unreasonable result, such provision or part thereof shall be stricken from this Release without affecting the binding force or effect of any other part or provision. This is intended to be a complete and unconditional release of liability and an unconditional indemnification to the greatest extent allowable by law.  This agreement shall be governed by the laws of the State of North Carolina. Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in Durham County, North Carolina and I hereby consent to the exclusive jurisdiction of such courts. I SPECIFICALLY WAIVE THE RIGHT TO TRIAL BY JURY.

I represent and warrant that I am at least eighteen (18) years of age. I acknowledge on behalf of myself, or the minors for which I am a parent or guardian, that I have read and agreed to the above release and waiver.

I grant permission for the Released Parties to use or authorize others to use any photographs, motion pictures, video or sound recordings, and/or other record of my participation in the Event, including my name, face, voice, picture, likeness, and image, for any legitimate purposes without remuneration to me and without the need for further approval. The Released Parties are, however, under no obligation to exercise any of these rights.

I UNDERSTAND THAT THIS RELEASE DISCHARGES THE RELEASED PARTIES FROM ANY LIABILITY OR CLAIM THAT I MAY HAVE AGAINST EITHER THE RELEASED PARTIES WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR PROPERTY LOSS THAT MAY RESULT FROM THE ACTIVITIES OR THE EVENT, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.
